The wife of the man who was hospitalized after consuming contaminated cantaloupe filed suit today in El Paso County District Court. The lawsuit is against Jensen Farms Inc. According to the complaint, Charles Palmer consumed the Listeria-contaminated cantaloupe in mid-August. He had purchased one whole cantaloupe at the Wal-Mart store which is located on Razorback Road in Colorado Springs. Soon he fell ill with symptoms of listeriosis and this was caused by Listeria infection. Within 24 hours his wife found him unresponsive and immediately rushed her husband to the hospital, where he has tested positive for Listeria monocytogenes, the strain of Listeria involved in the cantaloupe outbreak.

A Fort Collins man accused of killing his fiancée in a car crash faces prison time. Daniel Derby, 29 remains in Larimer County Jail while facing charges of vehicular homicide and assault while under the influence, among others. He was driving his Honda sedan on Timberline Road between Prospect and Mulberry when the vehicle swerved across the centerline, slamming into an oncoming Ford Explorer. The man and girl were riding a yellow dirt bike and were involved in a crash with a gold Dodge 3500 pickup truck. According to radio traffic the man was rendered unconscious in the crash, but later talked with deputies. He and the girl both suffered serious injuries, the radio traffic said.
